SplatScene Terms of Use (EULA)

1. Agreement

These Terms of Use are an agreement between you ("you" or "Licensee") and SplatScene ("we", "us", or "Licensor") for the SplatScene desktop application for macOS ("the App"). By downloading, installing, or using the App, you agree to be bound by these terms. If you do not agree, do not use the App.

2. License Grant

Subject to your compliance with these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices you own or control, as permitted by the Apple Media Services Terms and Conditions — Standard EULA, which is incorporated by reference. The App is licensed, not sold, to you.

3. Free and Pro Features

• The App is free to download and use as a viewer. Free use includes opening and exploring supported 3D Gaussian Splatting files, the Realistic visual effect, watermarked screenshots and recordings, and a 30-image cap for training runs.
• SplatScene Pro, a subscription purchased through the App Store, unlocks training, all five visual effects, cleanup tools, watermark-free capture and export, and a 500-image cap.
• Features may change over time as the App evolves.

4. Subscriptions, Trial, and Billing

• Pro is billed as an auto-renewing subscription through the App Store: $4.99/month or $34.99/year, unless a different price is displayed at the time of purchase.
• Eligible new users receive a free trial of Pro features: 3 days, or 2 successful training runs — whichever comes first.
• Payment is charged to your Apple ID at confirmation of purchase. The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
• You can manage or cancel your subscription at any time in System Settings → Apple ID → Subscriptions.
• Any unused portion of a free trial period is forfeited when you purchase a subscription, where applicable.

5. Acceptable Use and Restrictions

You may not copy, modify, distribute, sell, sublicense, reverse engineer, decompile, or disassemble the App, except as expressly permitted by applicable law or the App Store Terms of Use. You are responsible for ensuring the content you create or process with the App does not infringe any third-party rights or violate applicable law.

6. No Warranty and Limitation of Liability

The App is provided "as is" and "as available", without warranty of any kind, whether express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

7. Privacy

Your use of the App is governed by the SplatScene Privacy Policy. Processing of your files happens locally on your device; the App does not upload your scene files for processing.

8. Termination

These terms remain in effect until terminated. We may terminate this agreement at any time without notice if you breach these terms. Upon termination, your right to use the App ends, and you must stop using it and delete all copies.

9. Changes to These Terms

We may update these terms from time to time. Continued use of the App after an update means the revised terms apply. The most current version is always available at this page.
